Welcome to Prizm Insurance, Inc. ("Prizm", "we", "us", or "our"). These Terms of Service ("Terms") govern your use of our website (
www.prizminsurance.io), customer portal, tools, and related services (collectively, the “Services”).
For the purposes of these Terms, “you” refers to either:
an individual consumer accessing or using the Services for personal insurance needs (“End User”), or
a registered investment adviser or similar third party authorized to act on behalf of a client (“RIA”).
Where applicable, obligations, representations, and liabilities are jointly and severally attributable to both the RIA and the End User client. The RIA represents and warrants that they possess full legal authority to act on behalf of any client for whom they enter information, and that all consents required by law or regulation have been obtained prior to any use of the Services on that client’s behalf.
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 18 years old and reside in the United States. By using the Services, you represent and warrant that you meet these eligibility criteria and, where acting as an RIA, are duly registered and in good standing.
2. Your Relationship with Prizm
Prizm is a licensed insurance broker that helps users obtain quotes and purchase property and casualty insurance from third-party carriers. Prizm does not issue policies or collect premium payments directly. All premium payments are made directly to the insurance carrier.
3. Use of the Services
You agree not to:
Use the Services for any unlawful or unauthorized purpose.
Misrepresent your identity or authority.
Access or tamper with non-public areas or systems.
Attempt to reverse-engineer or misuse content, code, or data.
If you are an RIA submitting information on behalf of a client, you confirm that:
You have appropriate and documented legal authority to act on the client’s behalf.
You are solely responsible for the accuracy of all information you submit.
Your client has reviewed and approved the submission and resulting actions.
4. Quotes, Guidance, and Final Policies
Quotes are estimates provided by third-party insurers and not guaranteed. Coverage, terms, and pricing are ultimately determined by the carrier. You are responsible for reviewing all final policy documents.
5. Intellectual Property
All materials and content in the Services are owned by or licensed to Prizm. No portion may be used, copied, or distributed without prior written permission.
6. Disclaimer of Warranties
The Services are provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
7. Limitation of Liability
To the fullest extent permitted by law:
Prizm shall not be liable for any indirect, incidental, special, or consequential damages.
Our maximum liability to you for any claims is limited to $100.
RIA and End User clients agree to be jointly and severally liable for any obligations arising from use of the Services.
8. Arbitration Agreement and Waivers
PLEASE READ CAREFULLY. THIS SECTION AFFECTS YOUR LEGAL RIGHTS.
Prizm shall not be liAll claims and disputes arising from these Terms shall be resolved by binding individual arbitration, not court, except as noted below.able for any indirect, incidental, special, or consequential damages.
You and Prizm waive any right to a jury trial or class action.
Arbitration will be administered by the American Arbitration Association (AAA), following its Consumer Arbitration Rules.
Either party may seek interim relief in court to preserve the status quo.
This arbitration agreement survives termination of the relationship.
9. Indemnification
You agree to indemnify and hold harmless Prizm, its officers, agents, and affiliates from any claims, liabilities, or losses arising from your use of the Services or breach of these Terms. Where an RIA acts on behalf of a client, both parties are responsible for any resulting claims.
10. Changes to These Terms
We may update these Terms from time to time. We will notify you of significant changes and post the updated version with the effective date.
11. Governing Law and Venue
These Terms are governed by the laws of Illinois. Any permitted legal action shall be brought in courts located in Cook County, Illinois.
